Terms & Conditions of Use

The Nearlyweds! (NW) website and its associated websites are designed for personal use by the User (You) to create and share a wedding web site, an online destination to tell others about your upcoming wedding and share your experiences with them.

Registration data, including Content (see below), is subject to the terms of this agreement. As such, You understand that by creating a wedding web site You consent to the collection, storage and use of this information as stated below. It is our goal to keep all User Sites online indefinitely (but at least for two years) - unless directed otherwise by a You - and NW agrees to take reasonable measures to protect and preserve the Content that You have provided in your wedding web site.

NW provides its service to you subject to the following Terms & Conditions of Use (TCU), which may be updated by NW from time to time without notice to you. You can review the most current version of the TCU at any time by clicking on the "Terms & Conditions of Use" link on our home page. By using our Website(s) and creating a wedding web site, You acknowledge that you have read, understood, and agree to be bound by the TCU.

User License

The User (You) are licensed to create, access and edit the wedding web site You have created through the Nearlyweds! website. You acknowledge that you are over the age of 18. If you are under the age of 18, You acknowledge that You have obtained permission from a parent, guardian or other trust to create a wedding web site.

Member Account, Password, and Security

As part of the Registration process, You agree to provide NW with personal registration information that is complete and accurate, including contact information and secure credit card information. Should your personal information change, you agree to contact NW to update this information.

Upon completing the User Site, you will receive a password and account designation for accessing and editing the User Site. You are responsible for maintaining the confidentiality of the password and account, and You are fully responsible for all activities that occur under your password or account. You agree to notify NW immediately if you have reason to believe that your password or account has been compromised, including loss, theft or unauthorized use. NW cannot be liable for any loss or damage arising from the unauthorized use of your password or account.

Content of User Site

The User (You), understand that all information, data, text, software, music, sound, photographs, video, graphics, tags or other materials (Content), whether publicly posted or privately transmitted, are the sole responsibility of the User from whom such Content originated. This means that You are entirely responsible for all Content that is uploaded, posted, e-mailed, transmitted or otherwise made available through the wedding web site You have created. Under no circumstances will Nearlyweds! (NW) be liable in any way for any Content, and/or any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted and/or otherwise made available through the wedding web site that You have created.

In posting Content to the User Site that You have created, You warrant that You own all materials posted, and/or that You have the right to post such Content, and/or that You have been granted full consent of others to post such Content.

When creating a User Site, You agree not to post any Content that is: pornographic, obscene, sexually explicit, and/or harmful to minors; is blasphemous, depicts violence, threatens violence, and/or incites racial or ethnic hatred; is slanderous, defamatory, and/or violates a person's (living or dead) privacy or personal rights; is discriminatory as to age, race, and/or sexual preference; divulge any confidential, private and/or proprietary information about others; or falsely attribute content and/or other material to any person or entity.

By creating a User Site and/or posting Content, You acknowledge and agree to hold NW and its officers, directors, subsidiaries, employees, and/or affiliates harmless from any and all liability, damages, expenses, and/or losses for death, personal injury, and/or damage to property, including, but not limited to, reasonable attorney's fees arising directly or indirectly from infringement by You of third party intellectual property rights and/or copyrights, for divulging any confidential information and/or private information about others; or for any liability for slander and/or libel resulting from any comments or postings you might make on the User Site that You have created and/or from your breach of our Terms & Conditions of Use (TCU).

Site and Fee Information, and Refund Policy

When You create a wedding web site, You will be granted a 14-day hosting trial period without cost. During this time, You will have complete access to the User Site that You have created to add, delete or otherwise edit content 24 hours a day, 7 days a week. After the 14-day free trial period, You agree to pay a one-time fee which will be charged to the credit or debit card You provide during the payment process. Nearlyweds! offers a 30-day money-back guarantee from the date of payment - simply contact Nearlyweds! within 30-days of paying in order to receive a full refund. No pro-rated refunds are available, nor are any refunds available 31 days after the date of purchase.

Subject to our Terms & Conditions of Use (TCU), the wedding web site site that you create will remain online for at least two years. You may access the User Site that You have created at any time, 24-hours a day, 7 days a week without charge. Initial Registration is quick, easy and free. No other fees will be assessed at any time during the hosting of your User Site account.

The TCU will automatically terminate in the event that You unsubscribe or cancel the User Site you have created during the 14-day free hosting period. Should You unsubscribe or cancel the User Site you have created after the 14-day free hosting period, or should the User Site that You created be terminated by Nearlyweds! (NW) due to the breach of the TCU, there will be no refund of money paid to NW.

Termination

Nearlyweds! (NW) shall have the right to edit or delete your content and or terminate the User Site that You have submitted at our sole discretion without notice in the event that you breach any of the Terms of Service. or for other issues that make it no longer practical for NW to continue to operate the Website User Sites in whole or in part.

Conclusion

When You create an online User Site with Nearlyweds! (NW), you are stating that You have read and understood our Terms & Conditions of Use (TCU) as stated above, and that You will read these terms again from time to time, or at such time that NW announces changes in our TCU on our home page or by other publication, and that You will abide by the most current published rules should a dispute arise.

Therefore, in exchange for submitting or creating a User Site, you agree to accept these Terms & Conditions of Use (TCU), which disclaim liability for NW, assign to NW the copyright in your works and submissions (to the extent you own them), and license back to You the right (during your lifetime) to modify, alter, edit or delete the Content of your User Site.

The Terms & Conditions of Use (TCU) constitutes the whole of the legal contract between NW and You. Subject to national law to the contrary, these Terms & Conditions of Use will be governed by and construed in accordance with applicable United States law. In the event that any term or condition of this agreement is held to be invalid or unenforceable by any arbitration, or other binding decision, the remainder of this agreement shall remain valid and enforceable under United States law.

NW and its officers, directors and/or trust, reserve the right to assign this agreement, and/or to assign, license or subcontract any or all of our rights and/or obligations to others under this agreement at any time. You may not assign, license or subcontract this agreement or any of your rights or obligations under it without our express written consent.

NW reserves the right to modify, update and change the Terms & Conditions of Use from time to time without notice or acceptance by You. If any changes to this agreement are unacceptable to You, then You may discontinue use of the User Site at any time by notifying us in writing that You no longer wish to use our Website or User Site. Continued use of the User Site by You, now or following changes to this agreement, implies that you have read, accepted and agreed to any changes in the Terms & Conditions of Use.
